What is Mediation?

Mediation is the process to help two parties resolve their dispute before bringing a case to court, ultimately saving both parties significant time and money. Mediation can take place before or after a lawsuit is filed. In most counties, attending mediation is a pre-requisite to scheduling any hearing before the court. If the mediation is successful, then a mediated settlement agreement is executed by the parties. If the parties fail to reach a settlement, there is still an opportunity to enter into a partial mediation agreement, narrowing the issues that a court must determine.
